Section 6

If a recommendation is received from the scientific body in accordance with Section 5 and the management body is convinced that the following conditions exist, the body may issue a permit as specified to the person, organization or agency requesting the permit:-
(a) If a permit is requested for an activity other than breeding, if it is found that such wild animal or plant or its specimen is owned or controlled by the person, institution or agency requesting the permit,
(b) In case of a request for a permit for activities other than breeding, if it is found that the person, institution or body requesting the permit for such wild animal or plant or its specimen has received it in accordance with the prevailing law,
(c) If it is found that a certificate of healthiness of such wild animal or plant or its specimen has been obtained from the concerned body,
(d) If it is a live wild animal, there are adequate and suitable arrangements for its transportation and there is reason to believe that during transportation it will not be injured, harmed, harmed to its health or cruelly treated,
(e) The permit issued by the authorized body of the country to which such wildlife or flora or specimen is to be exported or the letter of intent to grant a permit or the country from which such wildlife or plant or specimen is to be imported into Nepal Yes, if it is found that the authorized body of that country has received a permit or a letter of intent to grant a permit for the export of such wild animals or plants or specimens thereof,
(f) If it is found that such wild animal or plant or specimen is to be used only for the purpose for which it is intended to be imported into Nepal and not for commercial purposes,
(g) If it is found that the assurance certificate is received from the authorized body of the country in which such wild animals or plants or the said species are to be exported to the country that it is not used for commercial purposes.
(1a) SubsecNotwithstanding anything written in clauses (e) and (g) of clause (1), when exporting endangered flora and fauna or their specimens, such permit and assurance given by the exporting country shall not be required.
(2) In order to be sure that the conditions as per sub-section (1) exist, the management body may request any complete document or copy as required and the related person, institution or body shall submit the documents as requested to the management body.
(3) When granting a permit in accordance with sub-section (1), the management body may specify in the permit the necessary conditions for the use, management, rearing, protection, habitat, means of transportation or route, etc. of such wild animals or plants or specimens thereof, and the person receiving the permit related to complying with such conditions, It will be the duty of the institution or agency.
(4) According to sub-section (1), the person, institution or body that has received the permit for the purpose for which the permit has been granted by the management body shall use or cause to be used for such wild animal or plant or the specimen only for that purpose.
(5) The permit granted according to this section which is obtained by a person, institution or body shall be valid only for the use of that person, institution or body and shall not be transferred for use by other person, institution or body.
(6) If the person, institution or body that has received the permit does any work contrary to subsection (3), (4) or (5), the management body may cancel the permit at any time after completing the prescribed procedure.
(7) Provisions regarding the duration, renewal, collection and cancellation of the permit shall be as prescribed.
