Rule 96
Impaired instincts
(1) If a civil servant is physically or mentally disabled for government service due to an accident or injury in the course of government work, such employee shall receive the pension as written in sub-rule (2) along with the pension as written in sub-rule (5) for the sake of his livelihood. He will get disabled allowance as written.
(2) According to sub-rule (1), if the service period of a civil servant who is disabled has reached the point of receiving pension, he/she will be immediately compensated (including if he/she has worked on a permanent basis or as an agent in accordance with rule 46) based on the salary calculated according to section 37 of the Act. He will get disability pension equal to the amount. If the service period of such a disabled civil servant has not reached the point of receiving pension, the remaining amount will be deducted from the damasahi for every full or half-year before reaching the year of receiving pension according to the law. While deducting in this way, more than one third of the amount will not be deducted.
(3) According to sub-rule (1), an amount of up to ten thousand rupees can be given as financial assistance to a civil servant who is disabled according to the condition of the injury. …………………
(4) In accordance with sub-rule (1), the concerned civil servant will receive 100% of the medical expenses incurred for the treatment of injuries. Due to the receipt of such treatment expenses, it shall not be considered that any obstacle has been created in receiving the treatment expenses which can be received according to sub-rule (1) of rule 94 when such employee becomes ill later.
(5) In addition to the disability pension received by the civil servant due to disability according to sub-rule (2), the amount of monthly disability allowance that he will receive will be equal to twenty percent of the salary he has drawn. Explanation: If a civil servant who has received disability or is expected to receive it, re-enters any service later, he will not get the disability mentioned in this rule. But the paid disability or additional financial assistance amount is not required to be returned.
(6) The death of any civil servant who is or has been adjudged to be entitled to disability within seven years from the date of commencement of such disability.If so, a lump sum amount will be given to the family members as per sub-rule (2) of rule 101 as disability subsidy for the remaining period of the seven years.
(7) Any civil servant who is disabled due to injury or dismemberment due to his own gross negligence will not be entitled to the benefits under this rule.
