(1) The formation of the Commission shall be as follows –
(a) A person appointed by the Government of Nepal from among the persons who have been or are qualified to be a judge of the Supreme Court - Chairman
(b) Appointed by the Government of Nepal from among the persons who have worked in the gazetted special category post of the Nepal Judicial Service or who have worked as a legal practitioner for at least fifteen years as a senior advocate or advocate or who have acquired at least fifteen years of experience in teaching, researching, drafting or in the field of law or justice. Person – Vice President
(c) Maximum three members, including at least one woman, nominated by the Government of Nepal from among the persons who have qualified as per clause (b)
(d) Secretary, Ministry of Law, Justice and Parliamentary Affairs – Member
(e) Secretary (Law), Office of the Prime Minister and Council of Ministers - Member
(f) Deputy Attorney General, Office of the Attorney General – Member
(g) Secretary – Member – Secretary
(2) There will be a recommendation committee as follows to recommend names to the Government of Nepal for the appointment and nomination of the chairman, vice-chairman and members of the Commission -
(a) Minister of Law, Justice and Parliamentary Order – Coordinator
(b) Chairman, Law and Human Rights Committee, House of Representatives - Member
(c) President, Nepal Bar Association – Member
