Article 140
Appointment and Qualification of Chief Justice and Judges of High Courts

(1) The Chief Justice shall appoint the Chief Justice and Judges of the High Court on the recommendation of the Judicial Council (2) Having obtained a bachelor's degree in law and working as a district judge for at least five years, or having obtained a bachelor's degree in law and having advocated continuously for at least ten years as a senior advocate or advocate, or at least ten years in law teaching, research or any other field related to law or justice. A Nepalese citizen who has worked or has worked at least five years in a gazetted first class post in the judicial service will be considered eligible for appointment to the post of Chief Justice and Judge of the High Court.
(3) At the time of appointing the Chief Justice and Judge of the High Court, from among the persons who have attained the qualification according to sub-section (2), in the case of the District Judge, based on the proportion of the cases decided by him annually and the assessment of whether the case is upheld, quashed or overturned at the time of the final decision in the High Court, at least the first gazetted first of the judicial service. The appointment will be made on the basis of evaluation of seniority, competence and performance level in the case of persons who have worked in the post for at least five years and in the case of others, seniority, professional continuity, honesty, professional conduct and contribution in the field of justice and law.
(4) If the position of the Chief Justice becomes vacant or if the Chief Justice is unable to perform his/her duties due to any other reason, or if the Chief Justice is unable to attend the High Court due to being on leave or out of the province, the senior most judge of the High Court shall act as the Chief Justice permanently.
