Section 17
Medical expenses
(1) When an official of a constitutional body is sick and undergoing treatment, he will receive the following medical expenses:-
(a) Expenses incurred during hospitalization and treatment in the home country according to the hospital bill and expenses of drugs purchased according to the prescription of the doctor of the hospital, but the doctor's prescription should mention the diagnosis of the disease.
(b) Expenditure as per the bill incurred for all types of chirfar (surgical operation) except plastic surgery. But the expenses incurred in a private nursing home will not be given.
(c) Spectacles, dentures, earphones, etc., as specified in the bill.
(2) Regardless of what is written in sub-section (1), no medical expenses shall be given in excess of the twelve months salary received by the office bearer of the constitutional body throughout the total service period.
(3) If the committee of doctors appointed by the Government of Nepal recommends that drug treatment cannot be done within Nepal, the official of the constitutional body who wants to go abroad for treatment may be given additional financial assistance as deemed appropriate by the Government of Nepal in addition to the treatment expenses received under sub-section (1).
(4) If the officer of the constitutional body dies before receiving the medical expenses due under this section, the person specified in sub-section (1) of section 19 shall be entitled to receive such medical expenses.
(5) If the husband, wife, mother, father, son or daughter of the official of the constitutional body falls ill, the official of the constitutional body shall be entitled to receive ninety percent of the medical expenses incurred according to the bill, up to half of that amount, deducted from the amount of the maximum medical expenses to be received according to sub-section (2). When requesting such treatment expenses, the doctor's prescription stating the diagnosis of the disease must also be submitted. However, the treatment expenses to be received according to this sub-section shall not exceed one month's salary of such official at one time.
(6) Spouse, mother, father, son or daughter of an officer of a constitutional body leaves due to illnessIn case of having to go to the hospital for treatment or having to be admitted to a hospital in the country and undergoing surgery or treatment, ninety percent of the expenses incurred according to the bill incurred in the hospital and the medical treatment expenses incurred according to the prescription of the doctor of the hospital will be received from the amount received by the official of the constitutional body according to sub-section (2).
(7) Notwithstanding anything contained in sub-sections (5) and (6), the spouse, mother or father of an official of a constitutional body, who is an employee in a constitutional position or in government service or in the service of an organization owned or controlled by the government, shall receive such medical expenses. no
(8) When the office bearer of a constitutional body retires, if there is any remaining medical expenses with or without taking some of the medical expenses received during the total service period according to sub-section (2), the office bearer of such a constitutional body will be entitled to receive a lump sum of two-thirds of the remaining amount after retirement. But the official of the constitutional body who has retired from the service in order to receive pension will be entitled to receive the remaining amount as a lump sum upon separation from the service.
(9) In the event that the official of the constitutional body who requests medical expenses in accordance with this section is ill and is unable to attend the office, he/she shall request sick leave as long as the sick leave is left. Only if there is no sick leave, other leave can be requested.
(10) According to this section, the details of the treatment expenses received by the officers of the constitutional bodies shall be kept in the leave records and personal records of the officers of such constitutional bodies.
