Rule 97
Provisions regarding appointment of teachers on contract

(1) If a permanent teacher cannot be appointed to the post approved by the Government of Nepal, if there is an immediate need to appoint a teacher on contract, the management committee shall obtain the list published for the appointment of teachers on contract from the Commission through the District Education Office.
(2) From among the candidates in the list obtained according to sub-rule (1), the management committee may appoint teachers on contract for a maximum of one academic session.
(3) According to sub-rule (1), if there is no candidate for contract in the list published by the commission or if the candidate included in the list does not receive an application to be appointed as a teacher, the management committee may appoint a person as a contract teacher for a maximum of one academic session on the recommendation of the teacher selection committee.
(4) According to sub-rule (2) or (3), when appointing a teacher on a contract basis, the appointment must be made only after the district education office has certified that the post is vacant and teachers can be appointed on a contract basis only if the subject is suitable for secondary and lower secondary level.
(5) In accordance with sub-rule (3), notice of advertisement for the appointment of teachers shall be posted at the district education office, the resource center of the relevant school and the relevant village development committee or municipality.
(6) According to sub-rule (3), the candidate applying for appointment as a teacher should submit his educational qualification, certificate of Nepali citizenship and health certificate in the format as per schedule-14 along with the application.
(7) The school should inform the district education office that teachers have been appointed on contract according to this rule.
(8) Notwithstanding anything written in sub-rule (2) or (3), if the permanent position is not filled in the vacant position even for one academic session in which the teacher is appointed under the contract, the management committee may extend the contract by six months at a time until the permanent position is filled.
(9) According to sub-rule (8), the school should give the information about extension of the deadline to the district education office.
(10) If a teacher is appointed without following the procedure according to this rule, the District Education Officer shall cancel such appointment.
