Rule 42A
Provisions relating to posting of work
(1) Section 18A of the Act. According to this, the approval of the Ministry of General Administration should be requested for the following things to be posted to civil servants in agencies that do not have civil service positions and in approved temporary posts:-
(a) the objective reason why the proposed civil servant should be employed in the body proposed to be employed,
(b) Details of the benefits that the civil servant who is assigned to the office will get other than the salary and allowance as per the rules, (c) Reasons why he/she is suitable for the job based on the performance, work experience, educational qualification, seniority, training etc. (d) Alternative arrangement for handling the work done by the civil servants who are assigned to work.
(2) In the case of temporary appointment, when seeking consent according to sub-rule (1), the consent must be sought for hiring a civil servant of the same level as the temporary appointment has been approved.
(3) According to this regulation, when the Ministry of General Administration gives consent to assign to work, whether the condition as per sub-rule (1) is fulfilled or not and whether consent to assign to work by giving preference to the most senior civil servants among the qualified and willing civil servants is sought or not. Within one month of the request, except for projects with a specified period, consent will be given only for the end of one financial year.
(4) If a civil servant under a ministry, secretariat, or commission has to be assigned to another ministry, secretariat, or agency under the commission according to sub-section (2) of section 18A of the Act, the civil servant is employed with the consent of the Ministry of General Administration upon the request of the central agency related to the agency to be assigned. The central agency related to the agency will have to assign the task.
(5) Section 18A of the Act. As per sub-section (2A), when assigning jobs to commissions or committees of a permanent nature, jobs will be assigned only to commissions and committees that are not civil service recruits.
(6) When assigning jobs according to sub-rule (5), the central agency of the agency employing the employee must obtain the consent of the Ministry of General Administration, along with the details of the request for civil servants from the relevant commission or committee.
