Section 72
Effect of Uncontrollable Circumstances
: (1) Even though the affected party has taken appropriate alternative measures to comply with the terms and conditions of this Petroleum Agreement, it shall not be considered as a breach of this Agreement if any party fails to comply with any of the terms and conditions of this Petroleum Agreement due to the creation of an uncontrollable situation. . But even in such a case, other activities related to petroleum exploration that do not have a direct impact should be reported.
(2) The affected party shall take all possible reasonable measures to eliminate the inability to fulfill the terms of this agreement without delay.
(3) In case of uncontrollable circumstances, the affected party shall give written information to the department within seven days of opening the following details:-
(a) Statement of circumstances beyond control,
(b) effects that may affect the rights or obligations of the affected party due to circumstances beyond its control,
(c) the estimated duration of the out-of-control situation,
(d) Description of the measures taken or to be taken to minimize the impact of uncontrollable circumstances.
(3A) After the end of uncontrollable circumstances, the affected party shall inform the department in writing that normal circumstances have been restored within seven days.
(4) Both sides will take appropriate measures to minimize the impact of the situation beyond control.
(5) If the petroleum work is postponed or delayed due to circumstances beyond control, the term of this petroleum contract shall be extended by more than thirty days of such postponement or delay.
(6) If petroleum work is suspended for one consecutive year due to uncontrollable circumstances as per section 71, either party may cancel the contract by giving fifteen days' written notice to the other party.
