(1) Before any person is detained or imprisoned in accordance with the prevailing law, a detainee allowance or prisoner allowance shall be given and no detainee or prisoner shall be kept in prison as a prisoner without such allowance.
(2) According to sub-section (1), if a person has to be detained for the purpose of investigation or preliminary investigation of any offense by the order of the court, he shall be sent to the prison after giving the following details:-
(a) The matter for which the order of detention for investigation or preliminary investigation has been made,
(b) / Brief description of offence,
(c) Period of detention,
(d) Court ordering detention.
(3) If a person who has been sentenced to imprisonment according to the judgment of the court has to be kept in prison, he shall be sent to prison after being given a prisoner's allowance containing the following details:-
(a) a brief description of the offense under which law and the punishment to be imposed, (b) the adjudicating court and the date of adjudication,
(c) Details of the punishment prescribed for the offense as per the judgment,
(d) Remaining period of imprisonment,
(e) details of judicial custody, if any.
(4) If a person has to be imprisoned for non-payment of a fine as per the court's decision, he shall be sent to prison with the following details:-
(a) Under which law. Details of how many fines have been imposed,
(b) Court of Judging and date of judgment,
(c) Amount of fine to be deducted for daily imprisonment,
(d) Fine/term of imprisonment in default.
(5) The court shall (in addition to the matters mentioned in the prisoner's petition under sub-section (3) or (4) the name, surname, nationality, year, character/hulia, name, surname, address, age of the person in custody, his father, mother and spouse, as well as If he is a Nepali citizen, the citizenship number and the district and date of issue, and if he is a foreigner, the passport number, the details of the entry permit, the country of issuance of the passport, the date of issue and the date of issue should be sent in writing to the relevant prison office. (6) If a prisoner does not accept the part given to him according to sub-section (2), (3) or (4), the employee who is responsible for submitting the part must report the fact to the employee of the local level or any office under it and keep his signature on the part. .
