Article 216
Provisions regarding Municipal Executive Chief and Deputy Chief

(1) There will be one municipal executive head in each municipality. City executive will be formed under his chairmanship.
(2) There will be one deputy head, ward president elected from each ward and members elected as per sub-section (4) in the city executive as per sub-section (1).
(3) The election of the head and deputy head shall be conducted by voters within the respective municipal area according to the electoral system in which one person is elected first by secret ballot on the basis of one vote. Explanation: For the purposes of this section, "Head and Deputy Head" means the Head and Deputy Head of the Municipal Corporation.
(4) Within fifteen days from the date of receipt of the final results of the Municipal Assembly elections as per Section 233, five women members elected by the Municipal Assembly members from among themselves and three members elected by the Municipal Assembly from the Dalit or minority community who have the qualifications as per sub-section (5) shall be members of the Municipal Executive. are.
(5) A person having the following qualifications shall be eligible to be elected to the post of Chief, Deputy Chief, Ward Chairman and Member:-
(a) Nepali citizens,
(b) having completed the age of twenty-one years,
(c) whose name is included in the electoral roll of the municipality, and
(d) not disqualified by any law.
(6) The term of office of the head, deputy head, ward president and member will be five years from the date of election.
(7) A person who has been elected to the post of chief for two terms shall not be eligible to be a candidate in the municipal election.
(8) The post of Chief, Deputy Chief, Ward Chairman and Member shall be vacant in any of the following cases:-
(a) If the head resigns in writing to the deputy head and the deputy head to the head,
(b) on expiry of his term of office,
(c) In case of his death.
(9) In the event that the term of office of the head or deputy head is more than one year remaining, if the position becomes vacant according to sub-section (8), the vacant position for the remaining period shall be filled by by-election.
