Section 28
Duties of the inspector
: (1) The inspector should check the measurements and weights and weighing instruments in the area and at the time specified by the controller.
(2) The inspector shall take the prescribed receipt and affix the inspection stamp as prescribed if the measure or weight or measuring or weighing device brought before him for the purpose of examination is found to be correct in accordance with this Act and the rules made under this Act.
(3) Any measure or weight or measuring or weighing instrument which is to be checked shall not be kept unchecked.
(4) The inspector may go and inspect the commercial measure or weight or measuring or weighing device or the measure or weight of the goods sold or given by such measure or weight or measuring or weighing device or any place where such measuring or weight measuring or weighing device is kept.< br> (5) The inspector may order the production of any measure or weight or measuring or weighing device and all related documents used by a trader or any person appointed by him for the purpose of his work or possessed by such trader or person or kept at any place for the purpose of business and such Traders or individuals should also submit instruments or documents according to that order.
(6) If the inspector suspects that any person has committed or is about to commit any offense under this Act in relation to a measure or weight or a measuring or weighing instrument, he shall sell or give away such measure or weight or measuring or weighing instrument or such measure or weight or measuring or weighing instrument. Or he can take possession of the goods and all related documents.
(7) If the inspector has reason to believe that the measurement or weight of the item in any sealed package is less than the measurement or weight mentioned in the level of that package, he may break the seal of such package and check the measurement or weight of the item in the package.
(8) When the inspector checks according to sub-section (7), if the measurement or weight of the package is not found to be correct, the inspector may take possession of the package and the contents of the package and if found to be correct, the proper value of the package shall be given to the owner of the package.
(9) If any agency or office of the inspector -provincial and local level within the scope of work - asks for advice regarding measuring or weighing and measuring air weighing device, the inspector shall give advice in this regard.
