Article 286
Constituency Determining Commission
: (1) In order to determine constituencies for the purpose of electing members of the Federal Parliament and Provincial Assemblies in accordance with this Constitution, the Government of Nepal may constitute a Constituency Determining Commission consisting of the following chairman and members:-
(a) Retired Judge of the Supreme Court – President
(b) One Geographer – Member
(c) One sociologist or anthropologist – member
(d) One member of administration or legal profession (e) Officials of special category of Government of Nepal - Member Secretary
(2) The term of office of the Constituency Determining Commission shall be as specified at the time of formation of such Commission.
(3) A person having the following qualifications shall be eligible to be appointed to the post of Chairman or Member of the Constituency Determination Commission:-
(a) Obtained at least a bachelor's degree in the relevant subject from a recognized university,
(b) having attained the age of forty-five years, and
(c) having high moral character.
(4) In any of the following cases, the post of chairman or member of the Constituency Determination Commission shall be vacant:-
(a) If he resigns in writing,
(b) If he is removed by the Government of Nepal, Council of Ministers,
(c) In case of his death.
(5) When determining constituencies by the Constituency Determining Commission in accordance with this section, subject to clause (a) of sub-section (1) of Article 84, the constituencies shall be determined in the province in accordance with the federal law, taking population as the main basis and geography as the second basis for representation, and each within the province There will be at least one constituency in the district.
(6) While determining the constituency according to sub-section (5), consideration should also be given to the population and geographical compatibility, population density, geographical specificity, administrative and transportation accessibility, community and cultural aspects.
(7) No question shall be raised in any court regarding the determination and revision of the constituency by the Constituency Determination Commission.
(8) Report of work carried out by the Constituency Determination CommissionIt will be submitted to the Government of Nepal.
(9) The Government of Nepal, the Council of Ministers shall send the report under clause (8) to the Election Commission for implementation in addition to submitting it to the Federal Parliament.
(10) Constituency Determining Commission shall determine its procedure itself.
(11) The remuneration and facilities of the Chairman and members of the Constituency Determination Commission shall be the same as the Chief Election Commissioner and the Election Commissioner of the Election Commission respectively.
(12) Constituencies determined in accordance with sub-section (5) shall be reviewed every twenty years.
(13) The Government of Nepal will provide the required staff to the Constituency Determination Commission.
