Section 18
Pension or Gratuity
(1) A person who has been appointed as an officer of a constitutional body shall, after retiring from that position, receive the following pension or gratuity:-
(a) If he has completed ten years of service as an official of a constitutional body, a monthly pension of sixty-six percent of his monthly salary.
(b) If a person who is in a constitutional position or in the service of the Government of Nepal is appointed or has been appointed as an officer of a constitutional body and retires from service, the service period of twenty years or more will be completed by adding the previous service period and the service period of serving as an official of the constitutional body. If so, he can choose either the monthly pension as per Clause (a) or the monthly pension calculated as follows:- Total years of service Monthly remuneration Explanation: For the purpose of this clause, "period of working in government service" means pension from the Government of Nepal or from an organized organization receiving subsidy from the Government of Nepal. According to the law that can be obtained, the period of being appointed to a position and working will be indicated.
(c) If the service period of the official of the constitutional body does not reach ten or twenty years when calculated according to clause (a) or (b), a lump-sum gratuity equal to the number of years of service completed by the number of one and a half months' salary received by him. will get money.
(2) For the purpose of calculating the period of pension in accordance with clause (a) of sub-section (1), half of the total period of working in a constitutional position or in a government service position or in both positions shall be calculated in the period of working as a chief official or official or in both positions.
(3) If a person who has received a gratuity in a constitutional position or for serving the Government of Nepal is appointed to the position of an official of a constitutional body, only if he returns the full amount of the gratuity received by him within one year of his appointment, his previous service period will be counted for the purpose of pension.
(4) In accordance with this section, the officers of the constitutional bodyThe amount of gratuity shall not exceed his twelve months salary.
(5) Two-thirds of the amount of the increase in the salary of the official of the constitutional body will be added to the amount of pension of the official of the constitutional body who is receiving pension.
(6) If a person who is receiving pension in a constitutional position or for serving the Government of Nepal is appointed to the position of an officer of a constitutional body and can also receive a pension in accordance with this Act, he may choose either the pension he is receiving before or the pension he will receive in accordance with this Act.
(7) Notwithstanding anything written in the above sub-sections, an official of a constitutional body who has been removed from office on the basis of lack of efficiency or bad conduct or not fulfilling his official duties honestly shall not be entitled to the benefits of pension or gratuity in accordance with this Act.
