Section 48
Obligation to employ and train Nepali people
: (1) The contractor shall employ Nepali citizens to the maximum extent possible in petroleum work and conduct education and training programs to maintain maximum participation of Nepali citizens in petroleum work at all levels. Every program and budget should contain provisions related to the work that the contractor is trying to do in that regard.
(2) In each contract year of the exploration period, the contractor shall spend at least ……….(…………….) dollars as directed by the department to provide education and training to Nepali citizens (who are not employees of the contractor) in the field related to the development of petroleum resources. Such amount will be spent on activities such as staff training, scholarship, seminars and purchase of equipment.
(3) Within sixty (60) days from the applicable date, the contractor shall provide an additional amount of …….. (…..) dollars as directed by the department for use in accordance with sub-section (2).
(4) After the end of the exploration period, the contractor shall spend the amount specified for education and training in the budget related to the production area in each year of the production period.
(5) The contractor agrees to arrange in-service training for the employees employed by the department to gain experience in the field of petroleum industry business suited to the petroleum work taking place in Nepal. The number and selection of employees to be employed and their terms of employment shall be as per the joint agreement. The qualifications and work efficiency of such employees should be in line with the level of contractors on behalf of Nepali workers. The remuneration of the employees assigned to the work will be as agreed between them and will be considered as petroleum expenses.
