Article 300
Judiciary Provisions
:(1) The Supreme Court, Constituent Assembly Court, Court of Appeals and District Courts existing at the time of commencement of this Constitution shall continue until the formation of the Judiciary according to this Constitution is prepared. This Constitution shall not be deemed to prevent the cases filed in such courts before the commencement of this Constitution and the cases filed after the commencement of this Constitution by the respective courts.
(2) The Chief Justice or Judges of the Supreme Court, the Chief Justice of the Court of Appeal, the Judge and the Judge of the District Court at the time of commencement of this Constitution shall be deemed to have been appointed in accordance with this Constitution.
(3) Within one year from the date of commencement of this Constitution, the High Court under Article 139 shall be established in accordance with the Federal Law. After the establishment of such a court, the Court of Appeals existing at the time of commencement of this Constitution shall be dissolved.
(4) After the establishment of the High Court in accordance with sub-section (3), the cases pending in the Court of Appeal shall be transferred to the High Court designated by the Government of Nepal in consultation with the Judicial Council by publishing a notice in the Nepal Gazette.
(5) Upon the establishment of the High Court in accordance with sub-section (3), the Chief Justice, on the recommendation of the Judicial Council, shall appoint the Chief Justice and Judges of the Court of Appeals who were in office at the time of commencement of this Constitution as the Chief Justice and Judges of the High Court.
(6) Judges in addition to the Court of Appeal who are in office at the time of commencement of this Constitution may remain in office for the specified period when appointed.
(7) Criminal offenses punishable by imprisonment for more than one year, which are under consideration in bodies other than courts at the time this constitution comes into force, will be transferred to the relevant district court after this constitution comes into force.
