(1) If any post in the civil service is not filled permanently for one year from the date of creation or vacancy, the post shall automatically be abolished. The relevant agency shall compulsorily give the details of the canceled posts to the Ministry of General Administration and Civil Libraries within seven days of the cancellation of such posts. After receiving such information, the Ministry of General Administration and the Civil Library shall update its records. However, the posts that are being filled up by the Public Service Commission and the promotion process has already started will not be cancelled.
(1a) Regarding the promotion or filling up of posts in the Public Service Commission, the concerned body must compulsorily provide the information to the Ministry of General Administration and the Civil Service Library.
(2) According to sub-rule (1), the notification of the canceled posts should be given by the civil library to the Ministry of General Administration, Ministry of Finance and Ministry of Services.
(3) In accordance with sub-rule (1), the official who does not give the details that the position has been vacant for one year and has been abolished will be punished departmentally by the authority considering that he has not fulfilled the duties of the position responsibly according to clause (d) of section 60 of the Act. But in the case of unranked civil servants, this arrangement will be implemented only after the main work and auxiliary work positions are separated.
(4) After retirement of civil servants working in gazetted third, fourth and fifth category and uncategorized posts, the library will automatically cancel such posts and update the records. The civil library should inform the relevant ministries, departments and offices about the canceled positions. However, according to sub-section (4) of section 7 of the Act, the fifth category or uncategorized posts that are designated to perform the main work shall not be cancelled.
