Article 289
Special provision regarding the citizenship of officials
: (1) To be elected, nominated or appointed to the post of President, Vice President, Prime Minister, Chief Justice, Speaker of the House of Representatives, Speaker of the National Assembly, Provincial Head, Chief Minister, Speaker of the Provincial Assembly and Head of Security Agency on the basis of descent. Should have obtained the citizenship of Nepal.
(2) Apart from the posts mentioned in sub-section (1), a person who has acquired Nepalese citizenship by descent, a person who has acquired Nepalese citizenship or a person who has acquired Nepalese citizenship by birth will also be eligible for appointment to the posts of constitutional bodies other than those mentioned in sub-section (1). But in the case of a person who has acquired the naturalized citizenship of Nepal, he must have lived in Nepal for at least ten years, in the case of a person who has acquired the citizenship of Nepal by birth and in the case of a person who has acquired the naturalized citizenship of Nepal in accordance with Article 11 (6), he must have lived in Nepal for at least five years.
