Article 306
Definitions and Explanations
: (1) In this Constitution, unless the subject or the context requires otherwise,–
(a) "Minority" means the ethnic, linguistic and religious group whose population is less than the percentage determined according to the federal law, and the term also refers to the group that has its own ethnic, religious and linguistic identity, aspires to protect it, and has suffered discrimination and oppression.
(b) "Law" means federal law, state law and local law.
(c) "Article" means the Article of this Constitution.
(d) "Municipalities" means metropolitans and sub-metropolitans.
(e) "Citizen" means a citizen of Nepal.
(f) "Province" means the area and nature of the federal unit of Nepal divided into federal units according to this constitution.
(g) "Remuneration" means salary, allowance and any other type of remuneration and benefits.
(h) "State power" means the power of the executive, legislature and judiciary of the state and the word also refers to the residual power.
(i) "Bill" means a constitutional amendment or a draft law introduced in the Federal Parliament or the Provincial Assembly.
(j) "Union" means the federal level which is the highest unit of the federal structure.
(k) "Federal unit" means Union, State and local level.
(l) "Constitutional Body" means the Commission for Investigation of Abuse of Authority, Auditor General, Public Service Commission, Election Commission, National Human Rights Commission, National Natural Resources and Finance Commission, National Women's Commission, National Dalit Commission, National Inclusion Commission established in accordance with this Constitution. , Tribal Commission, Madhesi Commission, Tharu Commission and Muslim Commission.
(d) "Marginalized" means a community that is politically, economically and socially left behind, unable to enjoy service facilities due to discrimination and oppression and geographical hardship or deprived of the same and in a lower position than the level of human development according to the federal law and thatIt also refers to marginalized and endangered communities.
(l) "Local level" means village councils, municipalities and district councils to be established in accordance with this constitution.
(2) Subject to the provisions of this Constitution, unless the subject matter or the context dictates otherwise, the legal provisions relating to the interpretation of laws shall apply to the interpretation of this Constitution in the same way as they apply to the interpretation of Nepalese laws.
