Section 19
Family pension or gratuity

(1) In the following cases, a pension or gratuity as per Section 18 shall be given to a person who is desired by the officer of the constitutional body from among his family members and in the event of death of such a desired person or to the next of kin among his family members for the following period:-
(a) In case of death of an officer of a constitutional body while holding office, up to seven years from the date of death,
(b) In case of death within seven years of starting to receive pension according to Section 18, for the remaining period of less than seven years. (2) If an officer of a constitutional body dies while holding office and if he does not receive a pension according to section 18 but only a gratuity, the amount of the gratuity shall be received by the person as per sub-section (1) among the members of his family. (3) If the official of the constitutional body dies while holding the position of the official of the constitutional body or within seven years of receiving the pension, his widow wife or widower will receive family pension according to sub-section (1), from the date of payment of such pension and if he does not receive such pension or his If the husband or wife dies after seven years have passed since the husband or wife started receiving the pension, the widower or widower will receive half the amount of the pension from the date of death. (4) Two-thirds of the amount of the increase in the salary of the incumbent constitutional body official will be added to the family pension of the person receiving family pension as per sub-section (1) and (3).
