Article 187
Prerogatives of Provincial Assembly
:
(1) Subject to this constitution, there shall be full freedom of speech in the Provincial Assembly and no member shall be arrested, detained or prosecuted in any court for any matter expressed or opinion given in the Provincial Assembly.
(2) Subject to this Constitution, the Provincial Assembly shall have full authority to act and make decisions and only the Provincial Assembly shall have the right to decide whether any of the Provincial Assembly's actions are regular or not. No question will be raised in this regard in any court.
(3) No commentary shall be made on any action of the Provincial Assembly, raising doubts about its good intentions, and no publication or broadcast shall be made in connection with any matter spoken by any member knowingly giving false or misleading meaning.
(4) The provisions of sub-section (1) and (3) shall also apply to other persons who are entitled to participate in the meeting of the Provincial Assembly except the members of the Provincial Assembly.
(5) No person shall be prosecuted in court for publishing any document, report, vote or action under the authority of the Provincial Assembly. Explanation: For the purposes of this sub-section and sub-sections (1), (2), (3) and (4), "Provincial Assembly" means the meeting of the committee of the Provincial Assembly.
(6) Members of the Provincial Assembly shall not be arrested for the period after the notification that the session has been called until the end of the session. However, this clause shall not be deemed to prevent any member from being arrested in accordance with law in any criminal prosecution. If any member is arrested in that way, the arresting officer shall immediately inform the person presiding over the Provincial Assembly.
(7) Violation of privilege shall be considered contempt of the Provincial Assembly and the Provincial Assembly shall have the right to decide whether any privilege has been violated or not.
