Article 162
Executive Powers of Provinces

(1) The executive authority of the province shall be vested in the provincial council of ministers in accordance with this constitution and provincial laws. However, if the provincial executive is not maintained due to the implementation of the federal government, the provincial chief will use the executive powers of the province according to the instructions of the Government of Nepal.
(2) The Provincial Council of Ministers shall be in charge of the general direction, control and operation of the governance system of the Province subject to this Constitution and other laws.
(3) The executive functions of the province will be done in the name of the provincial government.
(4) The executive powers of the provinces subject to this constitution shall be as mentioned in the list as per Schedule-6, Schedule-7 and Schedule-9. However, in relation to the common rights of the Union and the provinces, except for what is clearly mentioned in the constitution and the federal law, the provincial council of ministers should coordinate with the Nepal government when exercising executive powers.
(5) According to sub-section (3), the decision or order made in the name of the provincial government and the certification of the related authority shall be in accordance with the provincial law.
