Article 77
Vacancy of Prime Minister and Minister

(1) The office of the Prime Minister shall be vacant in any of the following cases:-
(a) If he tenders his resignation in writing to the President,
(b) If the motion of confidence cannot be passed in accordance with Article 100 or if the motion of no confidence is passed against him,
(c) If he is not a member of the House of Representatives,
(d) In case of his death.
(2) The post of Minister shall be vacant in any of the following cases:
(a) If he tenders his resignation in writing to the Prime Minister,
(b) If the Prime Minister dismisses him,
(c) If the post of Prime Minister becomes vacant as per clause (a), (b) or (c) of sub-section (1),
(d) In case of his death.
(3) If the position of the Prime Minister is vacant according to sub-section (1), the same Council of Ministers shall carry out the work until another Council of Ministers is formed. But in case of the death of the Prime Minister, the most senior minister will act as the Prime Minister until another Prime Minister is appointed.
