Section 107

Notwithstanding anything written elsewhere in this paragraph, if a witness who is outside the jurisdiction of the court in which the case is filed, or who is unable to attend the court for some reason but does not understand, is to be examined by questioning in view of the seriousness of the case, the court shall notify the parties of the same. > (2) If any party to the case wishes to include the questions he wishes to ask the witness in the closed question under sub-section (1), he may file an application in the open court.
(3) If there is an application as per sub-section (2) and if the court deems that such question should be included in such closed question, it will order to include such question in such closed question and the questions of closed question will be prepared accordingly.
(4) The format of closed questions will be as mentioned in Schedule-39.
(5) In accordance with sub-section (1), when a witness is examined by interrogatories, any party to the case may appear in the court to which the interrogatories were sent and examine, cross-examine or re-examine the witness in accordance with the prevailing law on evidence.
