Section 11
Prohibition on sale, distribution and display
: (1) No one shall be allowed to sell, distribute or cause tobacco products to be sold or provided free of charge to persons under the age of eighteen and pregnant women.
(2) For the purpose of sub-section (1), if the seller of tobacco products wants to be sure about the age of a buyer, he may demand the necessary proof and it shall be the duty of the buyer concerned to submit the proof requested by the seller.
(3) No one shall be allowed to sell and distribute tobacco products from any educational and health institution, child welfare home, infant care center, nursing home, orphanage, or any public place designated by the Government of Nepal by publishing a notice in the Nepal Gazette. > (4) The Government of Nepal may make arrangements by publishing a notice in the Nepal Gazette so that no one can sell and distribute cigarettes, BD or cigars as a retailer.
(5) No one shall be allowed to distribute or give gifts of tobacco products free of charge.
(6) The Government of Nepal, if it wishes, may arrange for a license to be obtained for the sale and distribution of tobacco products.
(7) No one shall be allowed to decorate the place of sale in such a way as to attract tobacco products and display such products.
