Section 17
Punishment
: (1) If anyone smokes or consumes tobacco in a public place contrary to this Act, the manager shall be punished as follows:-
(a) Immediate prohibition of smoking or consumption of tobacco and in case of non-compliance with such prohibition or frequent smoking or consumption of tobacco, he shall be expelled from such public place or shall be punished with a fine of one hundred rupees or both,
(b) If a person who smokes or consumes tobacco is a person or an employee related to a public place, smoking or consuming tobacco should be immediately stopped and if he smokes or consumes tobacco repeatedly, he should be considered as not disciplined and should be warned according to the law related to his service conditions or other departmental action should be taken .
(2) If the manager smokes or consumes tobacco in a public place contrary to this Act, he shall be deemed to be in violation of discipline and shall be subject to caution or departmental action by the authorized officer according to law.
(3) The manager shall deposit the amount taken as penalty in accordance with clause (a) of sub-section (1) in the revenue account.
(4) The decision made by the manager or authorized officer according to sub-section (1) or (2) shall be final.
(5) In the following cases, the officer looking into the case shall punish the concerned person as follows:-
(a) If notice is not given as per section 5, fine up to five thousand rupees,
(b) In case of non-compliance with Section 7, 8 and 9, confiscation of such tobacco products and a fine of up to fifty thousand rupees,
(c) Any act contrary to section 10, with fine which may extend to one lakh rupees,
(d) For any act contrary to section 11, fine up to ten thousand rupees,
(e) In case of doing any other act contrary to this Act except as mentioned in clauses (a), (b), (c) and (d), fine up to five thousand rupees.
