Rule 58
Sick leave

(1) Civil servants will get twelve days of sick leave every year.
(2) Civil servants will get full salary while on sick leave.
(3) If a civil servant falls ill and does not have enough accumulated sick leave, he can be given advance sick leave up to a maximum of twelve days.
(4) Civil servant on extraordinary leave and section 71A of the Act. Sick leave will also be available during the period of taking leave other than sick leave.
(5) Civil servants requesting sick leave for a period of more than seven days shall submit a certificate from an approved physician. But if the leave granting officer believes that it was not possible to submit such a certificate, he can approve the said leave without the certificate.
(6) The civil servants will be allowed to accumulate and keep the sick leave they have accrued.
(7) If a civil servant is separated from the service for any reason, he will be entitled to receive a lump-sum amount due to his accrued sick leave at the rate of salary from the position he is entitled to.
(8) In case of death of any civil servant without being able to take the accumulated sick leave amount, such accrued sick leave amount shall be taken by the person as per sub-section (5) of section 39 of the Act.
(9) If the sick leave and home leave are not available for treatment of a major or serious illness, the civil servant may take additional sick leave up to forty-five days by submitting a certificate from an approved doctor and deducting it from the sick leave and home leave received later. Civil servants who have already taken sick leave will get their full salary.
(10) If the leave taken according to sub-rule (9) is insufficient and additional leave needs to be taken, upon the recommendation of the medical board appointed by the Government of Nepal, the civil servant may take a maximum of one year of extraordinary leave during the entire service period by deducting it from the extraordinary leave. (11) In case of death of a civil servant who has taken sick leave in advance according to sub-rule (9), the sick leave so taken in advance will automatically be waived.
