(1) Section 39A of the Act. According to the law, if a civil servant who has not been contacted for two years and has not been found dead, the amount of gratuity or pension that he will receive will be given to his family if he is removed from service in accordance with clause (g) of sub-section (1) of section 61 of the Act.
(2) In order for the family of a civil servant as per sub-rule (1) to receive the amount as per the said civil servant's permanent residence, the village development committee or municipality and the district police office of the district in which the civil servant was present before the disappearance found that he has been missing for two years and has survived. It is necessary to take the recommendation of the non-applicant and submit it.
