Section 12B
Tests can be performed to determine whether or not there is complete brain damage
.
(1) A doctor may perform a health examination to determine whether the patient has complete brain damage or not, only if the following conditions exist in a patient:-
(a) incur irreparable damage,
(B) No response in the brain stem,
(c) The body of the patient is not breathing naturally.
(2) In order to conduct a health examination according to sub-section (1), the doctor shall obtain the written consent of any member of the patient's family.
(3) Regardless of what is written in sub-section (2), if no member of the patient's family is available for the health examination according to sub-section (1) or in the case of the patient, the doctor shall conduct the health examination of the patient in the presence of the head of the relevant health institution and the official representative of the district administration office.
(4) If the health examination as per sub-section (1) is conducted by the head of the related health institution, the other senior doctors of the health institution shall be kept in the Rohwar as per sub-section (3).
(5) If the medical examination performed by the doctor according to sub-section (1) shows that the patient's brain has been irreversibly damaged, there is no reaction in the brain stem, and the patient's body is not breathing naturally, the patient's health shall be re-examined six hours after such examination to ensure brain death.
