Article 158
Functions, Duties and Powers of the Attorney General

(1) The Attorney General shall be the chief legal advisor to the Government of Nepal. It shall be the duty of the Attorney General to advise the Government of Nepal and other officials appointed by the Government of Nepal on constitutional and legal matters.
(2) The Government of Nepal shall be represented by the Attorney General or his subordinate government attorney in cases involving the rights, interests or concerns of the Government of Nepal. Except as otherwise provided in this Constitution, the Attorney General shall have the right to make the final decision whether or not to prosecute a case before any court or judicial body or official on behalf of the Government of Nepal.
(3) When withdrawing the case filed on behalf of the Government of Nepal, the opinion of the Attorney General should be taken.
(4) The Attorney General may attend such meeting and express his opinion on legal questions in accordance with the invitation of the Federal Parliament or any of its committees.
(5) In the performance of his official duties, the Attorney General shall have the right to appear before any court, office and official in Nepal.
(6) In addition to sub-section (2), the Attorney General shall, in the performance of his duties, have the power to:-
(a) Defending on behalf of the Government of Nepal in cases filed as plaintiff or defendant,
(b) To monitor or cause the implementation of the legal principles that have been interpreted or rendered by the Supreme Court in case matters, (c) If there is a complaint or information that a person in custody has not been treated humanely under this constitution or that such a person has not been allowed to meet with relatives or through a legal practitioner, investigate and give necessary instructions to the relevant authorities to prevent such a thing from happening.
(7) The Attorney General may delegate his duties, duties and powers to the subordinate public prosecutors in order to exercise and comply with the prescribed conditions.
(8) In addition to the tasks, duties and powers written in this article, the other tasks, duties and powers of the Attorney General shall be in accordance with this Constitution and federal laws.
