Rule 160
Investigation and scope of the case
: (1) The head office may appoint an investigation officer to an armed police inspector or a higher ranking armed police officer to investigate and file a case against an armed police officer accused of any offense under section 27 of the Act.
(2) When the investigating officer designated as per sub-rule (1) arrests and detains the indicted armed police personnel in accordance with Section 29 of the Act, he shall be given custody in accordance with schedule-17.
(3) In accordance with sub-rule (1), the investigation officer shall search and obtain the things, objects and evidence related to the crime, identify them, take the statement of the accused, provide documents related to the details of the incident with the relevant persons and attach the document to the incident. .
(4) The accused who has been arrested and detained under sub-rule (2) shall not be detained for more than 24 hours except for the period of leave for investigation. If the investigation of the accused detained for investigation is not completed within 24 hours and it is found that he needs to be detained for an additional period, the investigating officer shall present him in the Armed Police Special Court and keep him in custody only after obtaining permission from that court. In this way, when asking for permission from the court, the accused should be asked for the permission, the basis of it, the reason why he should be detained and investigated.
(5) For seeking permission according to sub-rule (4), the Armed Police Special Court may order detention for a maximum of twenty-five days at one time or several times if the investigation is satisfactory after looking at the relevant documents.
(6) After the completion of the investigation, the investigating officer shall prepare a charge sheet in the format as per Schedule-18 and file a case in the Armed Police Special Court within the time limit, along with the evidence and items related to the crime, including the detainees. (7) A copy of the case filed in accordance with sub-rule (6) along with the indictment must be sent to the office of the public prosecutor concerned and the public prosecutor will act on defense and appeal on behalf of the armed police force in such a case.
