Section 25
Conditions for obtaining the right of mohi
(1) A person who has earned income as a mohi of the land of a land owner until the date of commencement of this section shall be entitled to the right of mohi according to this paragraph. … … …
(2) Notwithstanding anything written in sub-section (1), after the commencement of this sub-section, except for the acquisition of mohiani right in accordance with sub-section (1) of section 26, because someone has acquired the land of a land owner under any condition, such person shall not be entitled to mohiani right in that land. But
(1) Before the commencement of this sub-section, any person has filed a certified copy of the same in the village or municipality where the land is owned by a double written acknowledgment between the land owner and the mohi, and the mohi of the land has retained the mohiani right in such land within six months from the date of commencement of this sub-section. If an application is made, the designated officer will be able to provide the applicant with the necessary proof including the double written confession and maintain the right of ownership in such land.
(2) Before the commencement of this sub-section, this sub-section shall not be deemed to interfere with the decision of the case in accordance with the provisions immediately existing in this Act in any case pending before any committee, office or court.
(3) Apart from the mortgaged land, if the creditor himself has earned the mortgage from any other land owner in the specified area, subject to section 8, the creditor will receive mortgage rights on such land. As much as the maximum limit specified in section 8 is exceeded, the rights of Mohiyani shall remain with the Asami.
(4) Notwithstanding anything contained in sub-sections (1), (2) and (3):–
(a) If a person has earned the land from the land owner and has not earned it by his or his family's labor, then all the rights of the person who earned it will be terminated in relation to that land.
(b) Mohiani rights received by Mohiani should be registered in the prescribed registration book.
(5) Notwithstanding anything contained in sub-sections (1), (2), (3) and (4), the following persons shall not be entitled to a license:-
(a) a person earning household land, or
(b) non-Nepali citizens, or
(c) a person earning land owned by the Government of Nepal, or
(d) A person who earns the land designated by the Government of Nepal for the purpose of industrial business.
(2) Notwithstanding anything written in sub-section (1), after the commencement of this sub-section, except for the acquisition of mohiani right in accordance with sub-section (1) of section 26, because someone has acquired the land of a land owner under any condition, such person shall not be entitled to mohiani right in that land.
