In this Act unless the subject or context otherwise requires,–
(a) "Jaggawala" shall mean a person who has registered the land in his name and is entitled to the land as a result of such registration by paying property tax to the Government of Nepal in accordance with the prevailing laws of Nepal and the term also refers to the following person in relation to the following land:-
(1) A person who shall be registered as a land owner in relation to land that has been abolished as per Birta Abolition Act, 2016,
(2) In relation to the land belonging to the zamindar, the zamindar,
(2a) in the case of kipat, the person who enjoys such land on payment of the government or the person who enjoys such land on payment of such person according to custom,
(3) A person who has the right to register the land in his own name because he is the rightful owner or a shareholder of such land owner or because such land owner has given up his right according to law,
(4) If someone else takes the land belonging to such a land owner as a pledge or pledge and performs the enjoyment in accordance with the law, that person until such enjoyment is performed.
(b) "Mohi" should be understood as a farmer who cultivates the land of another land owner under certain conditions with his own or his family's labor.
(c) "family" in relation to a person shall include that person and his relatives in the following circumstances:-
(1) A husband or wife, whether separated or unseparated,
(2) A son, daughter,
who has not reached the age of 16 years, whether separated or not, while the father or mother is still alive. (3)………………
(d) "Koot" should be understood as cash or jinsi or both, paid by the tenant to the landlord for acquiring the land of the landlord.
(e) "Household" shall mean a house where a person lives and the land occupied by that house and the term shall mean a shed, bhakari, well, pond, garage, stable, fruit garden, vegetable garden, bamboo garden, kharbari, sports or It also refers to land used for entertainment and other similar purposes.
(f) in relation to any land, “main annual crop” means the average crop grown on that land during the yearIt should be remembered that the most profitable crops are grown.
(g) "Farmer" means a person engaged in farming. But for the purpose of fixing the loan according to paragraph 9, the word should mean a person who cultivates with his own or his family's labor.
(h) "Zimidari" shall mean the establishment of an agent under the name of Zimidar, Patwari, Talukdar, Jimmawal, Mukhiya, Thari, Dwara or any other name and by him, he shall collect the property and file it in the Nepal Government according to the law, and shall also include the custody arrangement.
(i) "Malpot" means the land owner to pay to the Government of Nepal in accordance with prevailing Nepalese laws and also any other similar amount.
(j1) "Ministry" shall mean the Ministry of the Government of Nepal dealing with matters related to land management.
(i2) "Department" means the Department of Land Management and Records.
(i3) "Office" means the office designated by the Ministry for dealing with land management.
(j4) "Land Reform Officer" means the head of the office. "
(j5) "Public Institution" means any of the following institutions:-
(1) Companies, banks or committees wholly or partially owned or controlled by the Government of Nepal, State Government or local level or commissions, institutes, authorities, corporations, foundations, boards, centers, councils and other organizations of a similar nature,
(2) Universities, co-educational schools that are fully or partially subsidized by the government of Nepal, run by the government of Nepal, the provincial government or the local level; Technical and vocational schools, schools, research centers and other similar academic, educational or health institutions,
(3) Government of Nepal or state government grant, grant or guarantee organization,
(4) An entity wholly or partially owned or controlled by an entity referred to in sub-sections (1), (2) and (3),
(5) Other organizations designated as public organizations by the Government of Nepal by publishing information in the Nepal Gazette. "
(J6) "Uchyog" means an organization registered as an industry according to the prevailing law.
(j7) “Establishment" means industries, educational institutions, health institutions and cooperatives registered according to prevailing laws.
(i8) "Company" shall mean a company registered in accordance with the prevailing law relating to companies.
(i9) "Project" means any development project carried out for a fixed period by the Government, Semi-Government, Private or Company.
(j) "Notified Order" shall mean the order published in the Nepal Gazette by the Government of Nepal.
(k) "Prescribed" or "as prescribed" shall mean prescribed or prescribed in the rules or notified orders under this Act.
