Article 252
National Commission for Women
: (1) There will be a National Commission for Women in Nepal. In which there will be a chairman and four other members.
(2) The President shall appoint the Chairperson and members of the National Commission for Women on the recommendation of the Constitutional Council (3) The term of office of the chairman and members of the National Commission for Women shall be six years from the date of appointment.
(4) Notwithstanding anything contained in sub-section (3), the post of Chairperson or member of the National Commission for Women shall be vacant in any of the following cases:-
(a) If he tenders his resignation in writing to the President,
(b) If he attains the age of sixty-five years,
(c) If an impeachment motion is passed against him in accordance with Article 101,
(d) If, on the recommendation of the Constitutional Council, the President dismisses him from office on the recommendation of the Constitutional Council that he is unable to perform his duties while in service due to physical or mental illness, (e) In case of his death.
(5) Chairman and members appointed according to sub-section (2) cannot be re-appointed. However, a member can be appointed to the post of chairman and if such a member is appointed to the post of chairman, the period of membership will also be counted as a pair when calculating his term of office.
(6) A person having the following qualifications shall be eligible for appointment to the post of Chairman and Member of the National Commission for Women:-
(a) Women who have made significant contributions in the field of women's rights, welfare or gender justice or women's development or human rights and law for at least ten years,
(b) In the case of the Chairman, having obtained a graduation degree from a recognized university,
(c) having completed the age of forty-five years,
(d) not being a member of any political party at the time of appointment, and
(e) Having high moral character.
(7) The remuneration and service conditions of the chairman and members of the National Commission for Women shall be in accordance with the federal law and as long as they remain in office, the remuneration and service conditions shall not be changed to their detriment. However, this arrangement will not be applicable in the case where the state of emergency has been declared due to extreme economic disorder.
(8) Chairperson or member of National Commission for Women Other Govtwill not be considered for appointment to this service. However, nothing written in this sub-section shall be deemed to be a hindrance to being appointed to a political position or to a position to investigate, investigate or investigate a subject or to submit an opinion, opinion or recommendation after studying or investigating a subject.
