Article 248
National Human Rights Commission
(1) There shall be a National Human Rights Commission in Nepal consisting of a Chairman and four other members.
(2) The President shall appoint the chairman and members of the National Human Rights Commission on the recommendation of the Constitutional Council (3) The term of office of the chairman and members of the National Human Rights Commission shall be six years from the date of appointment.
(4) Chairman and members appointed according to sub-section (2) cannot be re-appointed. However, a member can be appointed to the post of chairman and if such a member is appointed to the post of chairman, the period of membership will also be counted as a pair when calculating his term of office.
(5) Notwithstanding anything contained in sub-section (3), the post of Chairman or member of the National Human Rights Commission shall be vacant in any of the following cases:-
(a) If he tenders his resignation in writing to the President,
(b) If the resolution of impeachment is passed against him in accordance with Article 101,
(c) If, on the recommendation of the Constitutional Council, the President dismisses him from office on the recommendation of the Constitutional Council that he is unable to perform his duties while in service due to physical or mental infirmity,
(d) In case of his death.
(6) A person having the following qualifications shall be eligible for appointment as Chairman or member of the National Human Rights Commission:-
(a) In the case of the President, a retired Chief Justice or Supreme Court judge who has made a special contribution in the field of protection and promotion of human rights, or a person who has been active for at least 20 years in the protection and promotion of human rights or who has gained fame by making a special contribution in various fields of national life,
(b) In the case of members, the protection and promotion of human rights, working in the field of children's rights and interests, or having been active in various fields of national life for at least twenty years and gained fame by making special contributions,
(c) Graduated from a recognized university,
(d) having completed the age of forty-five years,
(e) Not being a member of a political party at the time of appointment (f) having high moral character.
(7) Members of the National Human Rights CommissionRemuneration and service conditions of employees and members will be in accordance with the federal law. As long as the chairman and members of the National Human Rights Commission remain in their positions, the remuneration and service conditions will not be changed to the detriment of them. But this arrangement will not be applicable in the case of declaration of emergency due to extreme economic disorder.
(8) A person who has been the chairman or a member of the National Human Rights Commission shall not be eligible for appointment to other government services. However, nothing written in this sub-section shall be deemed to be a hindrance to being appointed to a political position or to a position to investigate, investigate or investigate a subject or to submit an opinion, opinion or recommendation after studying or investigating a subject.
