Section 108
Affidavit to be made in court
(1) In accordance with this Code, the statement of the witness shall be made in the courtroom of the judge. However, if the affidavit of a witness who is unable to attend the court due to physical disability is to be obtained, the judge may go to the place where such witness is staying or send an authorized employee under him to obtain the affidavit.
(2) When the affidavit is issued in accordance with sub-section (1), the relevant parties of the case shall be notified and given an opportunity to conduct an examination in accordance with sub-section (5) of section 107.
