Rule 22
Unranked - Gazetted Fifth Class Posts
(1) The posts mentioned in Schedule-2 having the same type of work in which skills are developed on the basis of experience are considered as unranked posts.
(2) If the employees working in unclassified positions as per sub-rule (1) want to be included in the category according to sub-section (3) of section 14 of the Act, they will be maintained in the fifth category listed in the gazette.
(3) According to sub-rule (2), employees who are retained in the fifth category listed in the gazette will not be reduced in their previous salary.
(4) According to the Act and this regulation, those who have been retained in the fifth category listed in the gazette and who have reached the service period according to section 39 of the Act including the period of service including the period of service in that category and the former category, are not ranked. When a gazetted fifth grade employee is compulsorily retired, he will be promoted to a gazetted third grade post and retired according to that section.
(5) In accordance with sub-section (5) of section 17 of the Act, the employees who have been fixed in the fifth grade under the gazette can also participate in the internal competitive examination.
