Article 284
Provisions related to Constitutional Council
: (1) In accordance with this Constitution, there shall be a Constitutional Council having the following chairman and members to recommend the appointment of the Chief Justice and the heads and officers of constitutional bodies:-
(a) Prime Minister – Chairman
(b) Chief Justice – Member (c) Speaker of the House of Representatives - Member
(d) Speaker of the National Assembly - Member
(e) Leader of the opposition party in the House of Representatives - Member
(f) Deputy Speaker of the House of Representatives – Member
(2) When the position of the Chief Justice is vacant, the Minister of Law and Justice of the Government of Nepal shall be a member of the Constitutional Council when recommending the appointment of the Chief Justice.
(3) The Constitutional Council shall make a recommendation for appointment in accordance with this Constitution one month before the position of the Chief Justice or any head or officer of the constitutional body becomes vacant. However, in the event that such a post becomes vacant due to death or resignation, it can be recommended for appointment to fill the post within one month from the date of vacancy.
(4) Other functions, duties and rights of the Constitutional Council and the procedures related to the appointment of the Chief Justice or the head or officer of the constitutional body shall be in accordance with the federal law.
(5) The Chief Secretary of the Government of Nepal shall act as the Secretary of the Constitutional Council.
