(1) If there is any doubt that the educational degree obtained by the employee for the purpose of promotion is not related to the relevant service, group or sub-group, the following committee will decide in this regard:-
(a) Secretariat Secretary – Chairman
(b) The Secretary of the Public Service Commission or a gazetted first class officer of the Commission designated by him – Member
(c) The Secretary of the Ministry of Law, Justice and Parliamentary Affairs or a gazetted officer of the first class designated by him – Member
(d) One professor or expert in the relevant subject of any one of the world universities on the subject to be determined - member
(e) Officers appointed by the Secretary General – Member – Secretary
(2) If there is a dispute regarding the subject, grade and level of training received by the employee for the purpose of promotion, there will be an appropriateness determination committee as follows to determine equivalency in that matter: (a) Secretariat Secretary—Chairman
(b) The Secretary of the Ministry of Law, Justice and Parliamentary Affairs or a gazetted officer of the first class designated by him - Member
(c) Gazetted First Class Officer of the Public Service Commission—Member
(d) The head of the training institute or training center related to the subject of the training or the representative appointed by him, one member. (e) Head of Manpower Development Division of the Secretariat - Member
(f) Officers designated by the Secretary-General—Members—Secretary
(3) Regarding the educational qualification and training submitted by the potential candidate for promotion, before the meeting of the promotion committee, if the committee under sub-rules (1) and (2) determines affiliation or equivalence, such educational qualification and training score will also be counted for promotion. The Secretariat of the Committee will be in the Legislature-Parliament Secretariat.
(4) Subjects of educational qualification determined by the committee as per this rule shall be published by the Secretariat in the Nepal Gazette.
