(1) The Nepal Government shall be the plaintiff in the case to be prosecuted and set aside in accordance with Section 49 and such case shall be deemed to be included in Schedule-1 of the Civil Criminal Procedure Code, 2074. (2) The investigation and action of the case under section 49 shall be done on the basis of the report of the prison administrator or any employee of the prison office.
