(1) If a person misuses the information received from a public body without using it for the purpose for which it was received, a complaint shall be made before the Commission within thirty-five days from the date of being informed that the information has been misused by the concerned public body. (2) When investigating the complaint received according to sub-rule (1), if it is found that the person receiving the information has misused the information, the commission will punish such person according to the law.
(3) Before punishing according to sub-rule (2), if the Commission deems it necessary, the person accused of information misuse may be brought before the Commission and made to testify. 24 a. Appointment of information officer:- When a public body appoints an information officer according to section 6 of the Act, the administrative head working in the public body must appoint an officer who is second or third below him. 24 b. Relevant experts should be appointed :- According to clause (c) of sub-section (1) of section 27 of the Act, when expert members are appointed in the committee, experts related to the subject matter should be appointed.
24c. The basis and reason should be disclosed while classifying the information :- (1) The committee shall disclose the reason and basis while classifying any information to be confidential according to section 27 of the Act.
(2) After classifying the information according to section 27 of the Act, the committee shall provide the same information to the Commission. 24h Code of conduct can be made and implemented:- The commission can create and implement the official code of conduct for the employees working in the commission.
