5. Strategy

5.1. Access to telecommunications services for all

5.1.1. The following strategies will be adopted to provide telecommunication services all over Nepal by the financial year 2063-64:

5.1.1.1 The old service providers will be made to expand their services without subsidy.

5. 1.1.2. Mobile service providers will be selected based on the conditions of providing services in rural areas of Nepal.

5.1.1.3. In the eastern development region, services will be expanded to rural areas from licensed service providers based on the minimum subsidy in the year 2060.

5.1.1.4. In the remaining areas that are not served by the above-mentioned measures, the service will be provided by the service provider chosen by the tender on the basis of the minimum subsidy for rural telecommunication development. 5.1.2. It will be arranged that only one (1) percent customs duty will be levied on equipment imported by telecommunication service providers to provide services in rural areas. Nepal Telecommunication Authority will certify the imported equipment to provide service in rural areas.

5.1.3. The use of rural telecommunication will be accelerated by expanding telecommunication services to settlements scattered in remote and rural areas other than municipalities. To encourage this work, an annual Rs. License fee and annual fee will be waived for rural telecommunication service providers with income less than 2 million.

5.1.4. Everyone's access to telecommunication services will be implemented through a common telephone or other means of telecommunication. To facilitate the access of everyone by making maximum use of the existing facilities, the common use of the telephone and the arrangement that the telephone owner can resell the service to others will be kept open.

5.1.5. A rural telecommunication fund will be established for rural telecommunication development. The rural telecommunication fund will include the rural telecommunication fee, which must be paid by all service providers, grants from the Government of Nepal and funds received from donors. This fund will be operated by Nepal Telecommunication Authority.

5.1.6. Nepal Telecommunication Authority 2061-62 will prepare principles and procedures for the operation of the Rural Telecommunication Fund. The authority will determine the annual rural telecommunication fee. After the main objective of the fund is achieved, the Rural Telecommunication Fund can be closed. 5.2. Obligation to provide service

5.2.1 Obligation to provide service to all consumers in urban areas of Nepal will be enforced upon demand by the main service provider (Khsla Agmadbhalat). The main service provider cannot refuse to provide the service.

5.2.2 The main service provider will be forced to provide the service requested by other service providers. The main service provider has to provide the requested service within one month. If it is not possible to provide the service within one month, it should be informed about the additional time required to provide the service along with the reason for the delay. The main service provider shall compensate the service provider for unnecessary delay or disruption of the service or for changing the service without giving sufficient notice. Other service providers will have to compensate the main service provider for damages if they use the services provided by the main service provider in an irregular manner.

5.3. Development in Professional Services 5.3.1. Commercial telecommunication services will include leased lines, various data to connect commercial data networks, broadband, PABX network etc. The service provider will be provided with an open license to provide commercial telecommunication services. But the number of such game licenses may be limited due to limited resources such as radio spectrum etc.

5.3.2. The main service provider will have to provide broadband services with the latest technology, including commercial telecommunication services.

5.3.3. Permits will be provided to provide internet and other data services through cable television and wireless technology.

5.4. Liberalization of telecommunication sector

An environment will be created to be active. Accordingly, any service provider can provide any service. But in this arrangement like the radio spectrumThe number of service providers may be limited due to limited resources.

5.4.2. Arrangements will be made for interconnection between the networks of different service providers. Under this arrangement, the newcomer service provider will be able to operate the service in a fair manner. The main service provider shall publish the terms and conditions of interconnection and allow its network to interconnect with the network of newcomer service providers without discrimination. With reference to World Trade Organization and based on world best practices, Nepal Telecommunication Authority shall formulate interconnection regulations, which shall also include dispute resolution measures.

5.4.3. Telecommunications based on healthy competition and a market-directed price system established in the situation of unnatural and unhealthy competition between service providers or in the event of a price monopoly, price regulation can be done. 5.4.5. Uniform tax rules will be applied to all service providers.

5.4.6. The Government of Nepal will open its agencies to use the services of various service providers based on price and quality.

5.4.7. Any telecommunication service will not be classified as basic, mobile, additional telecommunication services etc. by giving formal support. Different consumers will have the right to choose the service according to their needs and interests.

5.4.8. Permit fees, radio spectrum fees and other fees will be collected only in such a way that they are sufficient for the operating expenses of the related agency.

5.5. An open permit system will be implemented

5.5.1. An open license system will be implemented for new service providers. In the open permit system, general permit and personal permit will be arranged. Separate permission should be taken for radio spectrum numbering capacity and resources like Chhnajat or Dhabath.

. A general license will be issued to those who meet the minimum qualifications. Get a general permitNe will be able to operate any service except the service that uses limited spectrum. But a person who has a general license can provide services with limited assistance from any other service provider. If a person who has received a general license wants to get a license, he will have to compete and be selected according to section 5-5.3.

5.5.3. Individual licenses will be provided to service providers selected through bidding. A limited number of telecommunication service providers will be selected due to limited spectrum. While choosing the service provider for the individual license, the maximum population in the rural areas will be served or similar basis will be taken. Individuals/organizations who have received individual licenses must obtain a general license to provide other services not mentioned in the individual license.

5.5.4. The method of prescribing license fees for the same type of service providers will be the same. In the case of annual fees, the Nepal Telecommunication Authority will set a fixed percentage based on the annual income certified by the auditor.

5.5.5. The previous license will be converted to the new system.

5.5.6. While granting the open license, the principle of technology neutrality will be adopted. The service provider will be able to select the telecommunication technology. The technology equipment chosen by the service provider should be modern and established and conform to international recognition. The former service provider will also have to enter the open license system and until they enter this system, the mandatory provisions related to technology in their license will remain the same.

5.6. Private sector participation will be encouraged

5.6.1. The participation of the private sector will be encouraged to attract investment in the telecommunication sector. 5.6.2. Foreign investment will be attracted in the telecommunication sector. There should be minimum 20 (twenty) percent indigenous participation in such investment. 5.6.3. The private sector will be regularly informed about the reforms in the telecommunication sector. In this regard, Chaloo DoorsanchaAnd the information related to field improvement and study will be notified from time to time by Ministry of Information and Communication and Nepal Telecommunication Authority.

5.6.4. The private sector will be informed about the method, process and other necessary content of obtaining an open and technology neutral permit. 5.7. Entering the Information Society 5.7.1. Telecommunication infrastructure will be developed for effective entry into the information society. 5.7.2. Through joint efforts with relevant ministries, agencies and the private sector, information and communication laws and other necessary arrangements will be made. 5.8. Appropriate information and communication technology for rural users

5.8.1. Users in rural areas will be encouraged to use appropriate information and communication technology. In this, the network of information and communication technology based on radio, television and telephone, which does not require training and does not require literacy, will be widely expanded. For this purpose, access to national radio and television broadcasting will be provided to the community from the surface of the earth and in other places through satellites.

5.8.2. Arrangements will be made to communicate information related to development as well as attractive programs related to information and communication technology through radio and television. 5.8.3. Small service providers will be mobilized to provide information and communication technology that requires special training and literacy.

5.8.4 A favorable environment will be created to provide information and communication technology facilities to the people through the private sector. 5.9. Those engaged in development work will be made to make full use of information and communication technology 5.9.1. All the central level agencies of Nepal Government will be connected to the Internet by the end of the financial year 2061-62. All information as well as published material will be available on the website of that body. Until the end of the financial year 2062-63, government agencies that provide direct service to the people, such as - agriculture, health, education, post office, etc., have access to e-mail and Internet access to employees with education up to secondary level.5.9.2. The capacity of the agency will be enhanced by designating a contact point capable of assisting and coordinating the use of information and communication technology. 5.9.3. The agency acting as a contact point will help various governmental and non-governmental agencies in the common use of information and communication technology in the development of rural areas. Development that benefits the people. Will keep up-to-date data of the project. Appropriate materials related to various information and communication technologies will be collected and made available through CDROM, Internet etc.

5.10. Commercialization of Nepal Telecommunication Institute

5.10.1 The Nepal Telecommunication Institute will be converted into a company immediately. The ownership of the Nepalese government will be gradually reduced and the ownership of the private sector will be increased in the converted company. 5.10.3. The company will be restructured to make it more efficient, effective, agile and increase productivity in providing services to the company. 5.11. Institutional Development for Policy Implementation 5.11.1. For the successful implementation of the telecommunication policy, the Ministry of Information and Communication and the Nepal Telecommunication Authority will be provided with sufficient amount of skilled manpower and other necessary resources. 5.11.2. In order to enhance the feeling of positive impact on the related parties, the contemporary telecommunication authority will publish an annual statement with the status of service provision, service fees, international standards of service level, international comparison and other necessary information. Ministry of Information and Communication and Nepal Telecommunication Authority will publish various study reports and useful information regularly.

5.11.3. Nepal Telecommunication Authority will publish a guide for service providers and consumers. Procedures for dispute resolution and other due processConsumers will be protected by way of analysis. 5.11.4. By clarifying the roles of the Ministry of Information and Communication and the Ministry of Science and Technology, policy making and implementation will be made faster, easier, simpler and transparent. 5.11.5. In Nepal Telecommunication Authority, the conditions and facilities of such appointment will be kept to attract people with high level professional skills.

5.11.6. Exemplary practices will be adopted in matters such as the protection of competition rules based on the principles of the World Trade Organization, interdependence, the obligation to provide services to all, open licensing procedures, independent and fair regulators and the use of limited resources.

5.12. Financial viability of the telecommunication sector

5.12.1. Economic efficiency in the telecommunication sector will be achieved by encouraging fair competition among telecommunication service providers. In this context, unless there is a separate legal provision related to competition, the relevant provisions will be immediately included in the Telecommunications Act. To the main service provider, the income of one service is used against the principle of competition, the income of another service is admitted, fixing the price with the aim of damaging and eliminating other competitors, misusing the information of the competitor and the best measures adopted by the business organization related to the competitor will be followed.
