Section 49A
Not to be employed or served elsewhere

(1) A civil servant should not engage in any type of employment elsewhere or provide services in the capacity of consultant, advisor, expert or in any capacity in order to receive financial benefit or any facility.
(2) Notwithstanding anything contained in sub-section (1), the following shall not be deemed to be hindered-
(a) to render services to any person in the course of the performance of his official duties or in the performance of an act prescribed or imposed by an authorized officer,
(b) To provide any service to the relevant educational institution or to perform any task imposed by such institution while studying in a domestic or foreign educational institution by taking a study leave in accordance with the prevailing law,
(c) National or international educational, academic or research organizations or regional or international organizations of which Nepal is a member country, to serve in the relevant body, provided that the authority approves the leave or work, as it is useful for the related service, group, sub-group,
(d) To participate in events at home or abroad, to give speeches or to present working papers, with the approval of the authority, without contradicting the policy of the Government of Nepal,
(e) To conduct training or research in an educational, academic or training institution outside of office hours with the prior approval of the authority,
(f) To carry out work or research related to training without interfering with office work in training institutions run by the Government of Nepal or fully or partially owned or controlled by the Government of Nepal,
(g) To provide services for human welfare, charity or social welfare without interfering with the work of the office,
(h) To join his professional organization or any other social organization in such a way that he does not get financial benefit or any facility, does not interfere with the work of the office and does not harm the Government of Nepal. Explanation: For the purpose of this section, "social organization" means a social association organization which is based on tradition and active in the society in order to meet the social needs and the term includes the prevailing law.It also refers to registered institutions related to literature, art, culture, sports, music, science, religion or any other similar genre or field. The employee to be trained in such training program and the person trained in such training program will not be allowed to participate in the process of such examination which will be conducted for one year thereafter.
