Rule 153
Motion of no confidence

(1) In accordance with clause (4) of Article 100 of the Constitution, one-fourth of the total number of members of the Assembly may give a written notice of motion of no confidence to the Secretary General or in his absence to the Secretary stating that the House has no confidence in the Prime Minister.
(2) Upon receipt of the notice in accordance with sub-rule (1), the Secretary General or in his absence, the Secretary shall immediately notify the Speaker.
(3) In any meeting seven days after the receipt of the notice in accordance with sub-rule (1), the speaker shall publish the date and time of the discussion on the motion of no confidence in the notice for the advance information of the members.
(4) On the day and time specified in accordance with sub-rule (3), after the Speaker calls the name of the first signatory member or the member authorized by him, that member shall present the proposal in the meeting and if he wishes, he may give his statement in this regard before submitting the proposal.
(5) The Speaker shall determine a time period for discussing the motion as per sub-rule (4) and at the end of that time period, if the Prime Minister or he is unable to attend the meeting due to unwellness or circumstances beyond his control, any minister authorized by him shall answer the questions raised in the motion and discussion.
(6) In accordance with sub-rule (5), after the Prime Minister or any minister authorized by him has responded, the proposing member may withdraw the proposal after taking permission from the meeting.
(7) If the proposing member does not withdraw the proposal according to sub-rule (6), the speaker will present the said proposal in the meeting for decision.
(8) The decision of the Assembly on the motion of no confidence shall be by division of votes with the signatures of the members.
(9) If the proposal according to this rule is passed by the majority of the total number of members present in the meeting, the Speaker shall inform the President thereof.
