Section 44
Filing of Fantari of Loans
(1) The designated officer shall issue a notice as prescribed and at the commencement of this section, the amount and interest of any agricultural loan outstanding from any farmer shall be recovered and accompanied by a copy of the written letter related to the Fantari loan of cattle and other agricultural implements as prescribed. Within 35 days of the issuance of the notice, he may order to be filed in the neighboring or related village or municipality, and the prescribed fantwari filed in the related rural municipality or municipality before the commencement of this sub-section shall be deemed to have been filed in accordance with this sub-section. But–
(a) If it is found that the deadline should be extended upon the application of the concerned person or for any other reasonable reason, the designated authority may grant an additional deadline of up to 35 days from the date of expiry of the deadline.
(b) If any government employee or person who has gone abroad is not able to file the Fantwari within the deadline, if such person applies to extend the deadline, the Government of Nepal or the designated authority may grant an additional deadline if deemed necessary.
(2) It shall be the duty of every creditor to file Fantwari as per sub-section (1). But if such creditor is a minor or a person without legal address, his guardian or rightful person should file a fantwari. Explanation: For the purpose of this section, agricultural loan shall mean a loan in cash or in kind given to the farmers for any of the following works, irrespective of the nature of the transaction mentioned in the transaction document:-
(a) Seeds,
(b) Loans in cash or in kind given to farmers for food,
(c) To give wages to the laborers employed for cultivation,
(d) Sewage,
(e) To pay freight, freight,
(f) Oxen and agricultural implements.
(3) For the purpose of this paragraph, if a question arises as to whether a loan is an agricultural loan or not, the designated officer shall decide the same by representing the representative of the village or municipality, including the land, if deemed necessary.
(a) If it is found that the deadline should be extended upon the application of the concerned person or for any other reasonable reason, the designated authority may grant an additional deadline of up to 35 days from the date of expiry of the deadline.
