Section 188

Except in the case of section 189, no one shall cause an abortion or cause an abortion with the intention of causing an abortion or by doing any act knowing or believing that the pregnancy may be aborted.
(2) No one shall cause a pregnant woman to have an abortion by coercing or threatening her or causing her to have an abortion.
(3) A person who commits or causes an offense under sub-section (1) or (2) shall be punished as follows:-
(a) Imprisonment for up to one year and fine up to ten thousand rupees for pregnancy up to twelve weeks,
(b) Imprisonment for up to three years and fine up to thirty thousand rupees if the pregnancy is more than twelve weeks up to twenty-five weeks,
(c) Imprisonment up to five years and fine up to fifty thousand rupees if the pregnancy is more than twenty-five weeks.
(4) An abortion shall be deemed to have been performed for the purpose of this clause if the child born alive as a result of such act dies immediately without causing an immediate abortion.
(5) If someone commits the act of killing a pregnant woman and the woman miscarries within twenty-five weeks or more than twenty-five weeks of pregnancy, the offender who commits such act shall be imprisoned for an additional five years in accordance with this Code or other laws.
(6) Notwithstanding anything contained elsewhere in this section, if any person commits any act against a pregnant woman causing an abortion, even if such act is not intended to cause an abortion, he shall be punished as follows:-
(a) Imprisonment for up to one year in case of pregnancy up to twelve weeks,
(b) Imprisonment up to three years if the pregnancy is more than twelve weeks up to twenty-five weeks,
(c) Imprisonment for up to five years if the pregnancy is more than twenty-five weeks.
(7) No one shall perform or cause any act to identify the sex of the fetus with the intention of causing an abortion, and shall not perform or cause an abortion after the sex has been identified.
(8) A person who commits an offense under sub-section (7) shall be punished as follows:-
(a) Imprisonment from three months to six months for any person who identifies or causes the sex of an unborn fetus with the intention of causing an abortion, and
(b) Those who identify the gender or cause an abortion shall be imprisoned for an additional year in the punishment written in sub-section (3).
