Section 20
Consent
Consent may be expressed orally or in writing or by gesture or conduct. However, consent given in the following cases shall not be considered as consent:-
(a) If any person gives permission under misrepresentation of facts or fear of any kind of loss or damage, and if the person acting in accordance with such permission knows that such permission has been given, and if there is any reasonable reason to believe that such permission has been given,
(b) In case of giving consent by a person who is not at the place of residence and unable to understand the merits, demerits and consequences of the consent given by him due to mental illness,
(c) for consent by a child under eighteen years of age,
(d) For giving consent under undue influence.
