Section 7
Civil Service Vacancies

(1) In accordance with sub-section (2) of section 19 in the gazetted special category posts of the civil service and the following posts will be filled as follows:- Post promotion through open competition through performance evaluation through internal competitive examination through seniority and performance evaluation
(a) Unranked ÷ Gazetted Fifth Class 100 % – – –
(b) Gazetted Class IV – – – –
(c) Gazetted Third Class – – – –
(d) Gazetted unsealed second class 70% – 20% 10% (e) Gazetted unsealed first class 40% 20% – 40%
(f) Gazetted Third Class 70% – – 30%
(g) Gazetted Second Class 10% 35% 20% 35%
(h) Gazetted First Class 10% 35% 20% 35%
(1A) Notwithstanding anything contained in sub-section (1), in the following cases the vacant position shall be filled as follows:-
(a) All posts reserved for promotion by seniority and performance evaluation cannot be filled in the absence of potential candidates, by promotions for the same year for which such post is allotted, provided that the gazetted notice referred to in clause (f) of sub-section (1) If there are no potential candidates for promotion through seniority and performance evaluation in third category posts and all or some of the posts cannot be filled, such vacancies will be filled through competition.
(b) If all or some of the posts allocated for promotion through performance evaluation cannot be filled without potential candidates, the posts for the year for which such posts are allocated through open competitive examination.
(c) All vacancies in the posts of service groups or sub-groups which are not posts below one category shall be filled by competition.
(1B) According to this section, the Public Service Commission will publish an advertisement after determining the number of posts for filling up the posts.
(2) At the commencement of this section, employees of the rank of Bahidar Vaso, employed in the fourth category not under the Gazette, shall, on commencement of this section.From this date, the gazettes will automatically remain in the third category.
(3) Notwithstanding anything written in clause (c) of sub-section (1), if no civil servant is held in the post of the third class ungazetted, such post shall automatically be abolished. If an employee working in a non-gazetted third-class post has reached the required service period for the post to be promoted and the educational qualification specified for one rank below the rank of the post to be promoted, he will be promoted to a post one rank higher. For such promotion, a higher rank post will automatically be created and the post held by him before his promotion to the higher post will be automatically considered to be abolished.
(4) The Government of Nepal will publish a notice in the Nepal Gazette and appoint unranked posts for main work and auxiliary work.
(5) The unranked posts that are vacant at the commencement of this section and will become vacant after the commencement of this section as specified in sub-section (4) will be canceled automatically. The work to be done from such positions should be done through a service contract with an agreement with the person or organization to set the minimum wage.
(6) In the position to be filled by internal competitive examination as per clause (d) of sub-section (1), the position shall be filled by competition from the employees working in gazetted third and unclassified posts who have completed the minimum educational qualification and minimum service period required for gazetted second class posts.
(7) Notwithstanding anything written in sub-section (1), in order to make the civil service inclusive, forty-five percent of the posts to be filled through open competition shall be set aside and that percentage shall be considered as 100 percent, and the posts shall be filled by separate competition only among the following candidates:--
(a) Women – thirty three percent
(b) tribal/tribe - twenty seven percent
(c) Madhesi – twenty two percent
(d) Dalits – nine percent
(e) Handicapped – five percent
(f) Backward Areas – Four percent Explanation:
(1) For the purposes of this sub-section, "backward area" shall mean the districts of Acham, Kalikot, Jajarkot, Jumla, Dolpa, Bajhang, Bajura, Mugu and Humla.
(2) For the purpose of clauses (a), (b), (c) and (d) of this sub-section, “female tribal/tribal, Madhesi and Dalit” means economically and socially backward women, tribal/tribal, Madhesi and Dalit. Must remember.
(8) Notwithstanding anything written elsewhere in this section, the posts of the percentage determined in accordance with clause (e) of sub-section (7) shall be filled by competitive examination in such a way that only those with disabilities can compete for work of a specific nature.
(9) In determining the percentage according to sub-section (7), if a coefficient (fraction) less than one percent is obtained, such coefficient will be shifted to the next group immediately after the coefficient in the case of the group.
(10) If a suitable candidate is not available in the advertisement of the year for which the advertisement is made for the post allocated according to sub-section (7), then such position shall be included in the advertisement of the following year and if no suitable candidate is available even after such advertisement, such position shall be filled by open competition in the following year. (11) The system of filling posts by the percentage determined according to sub-section (7) shall be reviewed every ten years.
(12) If there is any dispute while determining the number of posts according to the percentage as per sub-section (7), the decision of the Public Service Commission will be final.
(13) Notwithstanding anything written elsewhere in this section, the Government of Nepal may publish a notice in the Nepal Gazette and appoint a post so that only women can compete for a particular nature of work or post.
(14) Notwithstanding anything written elsewhere in this section, only women candidates who have completed the minimum qualification required for a post and who have served in the permanent position of the women's development program run by a government agency for at least five years at the time of commencement of this section, shall be eligible for the designated post after the commencement of this section. Competition fixed by Public Service CommissionA permanent appointment can be made by taking the aptitude test.
(14A) In the post of gazetted up to the second class to be promoted through the internal competitive examination mentioned in sub-section (1) of section 7, in the service as per this Act, Legislature-Parliament Secretariat Act, 2064 and Nepal Health Service Act, 2053, who have reached the prescribed period of service and qualification for that post. All employed employees will be potential candidates.

(16) Notwithstanding anything contained elsewhere in this section, the minimum qualification required for the gazetted second and first class posts to be filled by open competition as per clauses (g) and (h) of sub-section (1) is to have obtained a master's degree in the relevant subject and to have obtained a master's degree in any government service or In the case of gazetted second class post and seven years in the case of gazetted first class post, the official level position of an organized organization or international association registered according to prevailing laws should have been obtained. But in the case of a person who has obtained a bachelor's degree, the period of experience will be reduced by two years.
(16A) Notwithstanding anything written in sub-section (16), the experience of working partially in any agency shall not be counted for that purpose. Explanation:- For the purposes of this sub-section, "partially employed" means employed for less than forty hours per week.
(17) Other arrangements related to the filling of civil service posts and the arrangements related to the filling of expert posts shall be as prescribed.
