Rule 123
Computation of prior service period
(1) While calculating the previous service period of the civil servant, it will be calculated as follows:-
(a) For the purpose of calculation of seniority for promotion, 100% of the period of service previously held in the civil service or permanent appointment in a post (if it is broken in between, the broken period shall be deducted) and the service shall be kept unbroken by serving in the development position first and the first civil service in the general category. After serving more than one year on a temporary basis and keeping that service uninterrupted, the development of past experience or temporary service period of a civil servant who has been permanently appointed to the civil service shall be calculated as follows:-
(1) Thirty-three percent of the service period in gazetted first class (2) Fifty-five percent of the service period in the gazetted second category (3) Sixty-six percent of the period of service rendered in the gazetted third category (4) Seventy-five percent for the period of service rendered in gazetted category and attendant post (b) For the purpose of pension, the period of service previously completed in government service or permanent appointment (if interrupted, the interrupted period shall be cut off) and ………….. appointment to the development post prior to date 2026.8.11 shall not be interrupted. The period of service of the civil servants who entered permanent service in such ordinary and developmental positions.
(2) Notwithstanding anything written in sub-rule (1), if a person who has received gratuity for any previous government service is re-appointed to a civil service position, only if he returns the amount of gratuity previously received, his previous service period will be counted in the current position according to this rule.
(3) The civil servants working in the civil service at the time of commencement of this regulation must complete their service period in accordance with this regulation within one year from the date of commencement of this regulation and the civil servants appointed after the commencement of this regulation must complete their service period within one year from the date of appointment. If the service period is not added within the said period, such service period will not be added later.
(3a) Death of a civil servant in a vehicular accident in the course of government workIf yes, he can get pension by adding his previous government service period, then Nepal government can decide to add his previous service period for pension.
(3b) By any process other than as written in this rule, the previous service period: cannot be added and the service period can be added.
(4) According to sub-rule (3), a civil servant adding the previous service period to the current service shall submit the details of the study leave, extraordinary leave, medical treatment expenses and insurance records taken before adding the service to the civil library. Explanation :- For the purpose of this rule, 'Government Service' means civil service, parliament service and health service receiving pension from the state fund of the Government of Nepal.
(5) Notwithstanding anything contained elsewhere in this rule, if an employee who has been permanently appointed to a post in the government service has been recommended for appointment to another post in the civil service through open competition, if he resigns from his previous post, the period of service rendered in the post vacated by such resignation shall not be added for the purpose of this rule. .
