Rule 176
Things to consider when performing delegated management tasks

(1) The committee under rule 170 should also take into consideration the following matters while discussing the delegated management:-
(a) Whether or not the Government of Nepal has made the rules to be made under the authority delegated by the Act,
(b) whether the rules have been made in accordance with the purpose of the Constitution or the Act,
(c) Whether the subjects prescribed by the Act are included in the rules or not (d) Whether or not the imposition or collection of any tax falls within the rules,
(e) whether the rules made in accordance with the provisions delegated by the Act directly or indirectly interfere with the jurisdiction of the Court,
(f) whether the rule is retroactive or not in relation to any provision where no such right is expressly provided by the Constitution or the Act,
(g) Whether or not any expenses are incurred from the accumulated fund or other government funds in the rules,
(h) Whether the rule is within the limits of the powers conferred by the Constitution or the Act,
(i) whether there has been undue delay in publishing the rules and submitting them to the Secretariat of the Federal Parliament, and
(j) Whether or not any clarification is required to clarify the intent of such rule.
(2) The committee may also include the following topics when presenting its report to the assembly:-
(a) If it is found that any rule in addition to that mentioned in sub-rule (1) should be repealed or amended in whole or in part, a recommendation with the reasons thereof, and
(b) The instructions given by the Minister to the relevant bodies after studying what steps have been taken by the Government of Nepal to fulfill the assurances given by the Government to the Assembly or Committee from time to time.
(3) In the report according to sub-rule (2), if it is seen that the assembly needs to be informed about other matters related to any rule, that matter should also be disclosed in the report.
(4) Any member may submit amendments to the report submitted in accordance with sub-rule (2) as deemed appropriate by the Speaker.
(5) The Speaker shall fix a day and time to discuss the report presented by the committee and any amendments thereto..
(6) The question raised during the discussion on the report and amendment according to sub-rule (2) will be answered by the concerned minister at the end of the discussion.
(7) After the decision on the amendment is made, the report's recommendations will be presented to the decision-making meeting in a presentation form or with approved amendments according to the situation.
(8) The secretary shall inform the concerned minister of the decision under sub-rule (7).
(9) The recommendation of the committee passed by the assembly shall be implemented by the concerned minister.
(10) In the course of implementing the recommendation according to sub-rule (9), the Minister shall inform the Federal Parliament about the amended or repealed rules.
