Section 19
Promotion
(1) Except for the gazetted post of Nepal Justice Service, the promotion to the gazetted post of civil service shall be done on the recommendation of the promotion committee as per Section 20.
(2) Notwithstanding anything contained elsewhere in this Act, promotions shall be made to the gazetted special category posts as follows:-
(a) In the case of promotion to the post of Chief Secretary of the gazetted special category, the Government of Nepal will select and promote from among the existing secretaries on the basis of seniority and efficiency.
(b) Gazetted special category secretary or equivalent post:-
(1) The potential candidates who have obtained an average score of ninety-five percent or more in the performance evaluation in twenty percent of the vacant positions and have the longest service period in the gazetted first class or equivalent position of the relevant service will be promoted by the Government of Nepal on the recommendation of the promotion committee.
(2) The government of Nepal will promote the candidate who is considered suitable based on seniority and efficiency from among the candidates recommended by the Promotion Committee, in triple the number of vacant posts, as far as available from among the potential candidates of the respective service who have obtained the highest marks based on the performance evaluation in eighty percent of the vacant posts. However, in the case where there are not three times the number of potential candidates in a service, it shall not be considered as a hindrance to recommending less than three times the number of candidates.
(2A) Notwithstanding anything contained in sub-sections (1) and (2), promotions shall be made from the following employees to the post of special category under the Gazette of the following services:-
(a) Nepal Agriculture and Forest Service posts of Nepal Agriculture Service and Nepal Forest Service gazetted first class employees and
(b) Gazetted first class employees of Nepal Economic Planning and Statistics Service, Nepal Administration Service, Nepal Miscellaneous Service and Nepal Education Service in the post of Nepal Administration Service.
(3) According to this section, when the promotion committee makes a recommendation, after making a recommendation as per sub-section (1), it will make a recommendation as per sub-section (2).
(4) Public service for filling posts under this sectionThe commission will determine the number of posts. (c) To be a potential candidate for the post of secretary or similar special category, gazetted first class employees must also have passed the high level management training prescribed by the Government of Nepal. However, this provision will not apply to promotion within one year after the commencement of this section.
(d) When calculating the performance evaluation for the promotion of the specific category as per clause (b), the minimum service period of the year required for the promotion, the performance evaluation of the last year will be calculated. However, after the commencement of this section, in the case of promotion within the month of Kartik year 2064, the promotion will be based on the performance evaluation of the last three years in the case of women, tribal/tribal castes, Madhesi, Dalit, disabled and backward employees and in the case of others, the last four years up to the end of the month of Ashad year 2063. .
(e) A potential candidate should be recommended within fifteen days from the date of vacancy of any specific category of civil service and the vacancy should be filled within fifteen days from the date of recommendation.
